These Terms and Conditions ("Terms") govern your access to and use of the Luminous Archives website, including all content, features, tools, products, and services offered on it (the "Services"). Luminous Archives is powered by Shopify. By accessing or using the Services, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

If there is a conflict between these Terms and our Privacy Policy, the Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information; these Terms control for all other matters.

  1. Eligibility

You must be able to form a legally binding contract to use the Services. If you are under the age of majority in your province or territory, you may only use the Services with the involvement of a parent or guardian.

  1. Products

Luminous Archives sells toys and cards. Product descriptions, images, pricing, and availability are presented as accurately as possible, but we do not warrant that they are error-free, complete, or current. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information, cancel orders, or refuse service at any time without prior notice, including after an order has been submitted.

Many of our products carry manufacturer age grading and safety information (e.g. choking hazard warnings for small parts). It is your responsibility to review this information on each product page and select items appropriate for the intended recipient. Luminous Archives is not liable for injury or harm resulting from a product being used outside its intended age range or manufacturer guidelines.

  1. Orders and Payment

By placing an order, you represent that you are authorized to use the payment method provided. All prices are listed in Canadian dollars unless otherwise stated and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If your order is cancelled after payment has been processed, you will receive a full refund.

  1. Shipping

We currently ship within Canada only. Estimated delivery times are provided for convenience and are not guaranteed. Luminous Archives is not responsible for delays caused by couriers, customs, weather, or other events outside our control. Risk of loss and title for items purchased pass to you upon our delivery to the carrier.

  1. Returns and Refunds

All sales are final. We do not offer returns or refunds. Please review product details, age grading, and photos carefully before purchasing. This policy does not affect any statutory rights you may have under applicable Canadian consumer protection law that cannot be waived by agreement (see Section 7, Warranty).

  1. Warranty

Every product comes with a full one-year warranty from the date of purchase, covering manufacturing and material defects. If a covered issue arises within the warranty period, we will provide a complete replacement of the item at no cost, upon proof of order and receipt.

The warranty is void if the product has been deliberately damaged, altered, or misused, or used for any purpose other than its intended use. It does not cover normal wear and tear, or damage arising after the warranty period has ended. To make a warranty claim, contact us at the details below with your order number and proof of purchase.

  1. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

  1. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to the Services, other accounts, or our systems; interfere with or disrupt the Services, including through malware, scraping, or automated means not authorized by us; post or transmit content that is unlawful, infringing, or harmful; or misrepresent your identity or affiliation with any person or entity.

We reserve the right to remove content, suspend access, or terminate accounts that violate this section.

  1. Intellectual Property

All content on the Services, including text, graphics, logos, images, and software, is owned by or licensed to Luminous Archives and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent.

  1. User Content

If you submit reviews, comments, or other content to the Services, you grant Luminous Archives a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, and display that content in connection with the Services. You are solely responsible for the content you submit and represent that you have the right to share it.

  1. Third-Party Links and Services

The Services may contain links to third-party websites or services, including those operated by Shopify partners. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party sites or services is at your own risk and subject to their own terms.

  1. Disclaimer of Warranties

Except for the express warranty described in Section 6, the Services and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except to the extent such warranties cannot be excluded under applicable law.

  1. Limitation of Liability

To the fullest extent permitted by law, Luminous Archives, its owners, and its service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services or products purchased through them. Our total liability for any claim arising from these Terms or your use of the Services will not exceed the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable Canadian consumer protection law.

  1. Indemnification

You agree to indemnify and hold Luminous Archives harmless from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

  1. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising from these Terms or the Services.

  1. Changes to These Terms

We may update these Terms from time to time to reflect changes to our practices or for legal, operational, or regulatory reasons. We will post the revised Terms on this website and update the "Last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

  1. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
